🔆 MODEL MAINS Q/A

📍 Q. The Anti-Defection Law seeks to maintain the stability of governments by preventing elected members from changing their political affiliations. However, some critics argue that it strikes at the heart of parliamentary democracy by restricting freedom of conscience. Discuss in detail. (15 Marks | 250 Words)

📍 Answer
Introduction: The Anti-Defection Law, introduced through the 52nd Constitutional Amendment Act, 1985 and incorporated in the Tenth Schedule, sought to curb political instability caused by unprincipled floor-crossing. However, excessive party control over legislators has raised concerns about legislative independence and deliberative democracy.

📍 Rationale and Significance
✅ Political stability: Prevents frequent defections and the recurrence of “Aaya Ram, Gaya Ram” politics
✅ Party discipline: Ensures coherence between a party’s electoral mandate and its legislative conduct
✅ Checks horse-trading: Discourages legislators from switching allegiance for political or material inducements
✅ Stable coalitions: Reduces opportunistic realignments that can destabilise elected governments

📍 Democratic Concerns
✅ Freedom of conscience: Broad use of party whips restricts legislators from exercising independent judgment on policy matters
✅ Weakens deliberation: MPs and MLAs risk becoming mere agents of political parties rather than representatives of their constituents
✅ Centralises party power: Strong whip-based control can weaken intra-party democracy and legitimate dissent
✅ Biased adjudication: Vesting disqualification powers in the Speaker has raised concerns over partisan decisions and delays
✅ In Kihoto Hollohan v Zachillhu 1992, the Supreme Court upheld the law while subjecting the Speaker’s decisions to judicial review

📍 Way Forward
✅ Restrict binding whips primarily to votes affecting government survival, such as confidence and no-confidence motions
✅ Ensure time-bound adjudication of defection petitions to prevent strategic delays
✅ Consider an independent adjudicatory mechanism instead of sole reliance on the Speaker
✅ Strengthen intra-party democracy and institutionalise consultation before issuing whips

📍 Conclusion
The Anti-Defection Law remains necessary for preventing political opportunism, but government stability cannot come at the cost of legislative autonomy. Narrowing the scope of whips and ensuring impartial, timely adjudication can better balance political stability with representative democracy.

🔆 Examine the Reasoning Behind India’s Proposal for ‘New Orientation for a Reformed Multilateral System (NORMS)’

📍 Introduction
✅ Multilateralism is key to global governance, promoting cooperation among nations.
✅ India recently proposed NORMS to reform this system.

📍 Background on Multilateral Institutions
✅ Institutions like the United Nations (UN), World Health Organization (WHO), and International Monetary Fund (IMF) have historically guided global governance.
✅ They influence peace, health, and economic stability worldwide.

📍 Rationale Behind the NORMS Proposal
• Lack of Inclusivity and Representation
◦ UN Security Council’s permanent members remain unchanged since 1945, excluding many Global South nations (UN reports).
• Misuse of Veto Power
◦ From 1970 to 2021, US, Russia, China, UK, and France used veto over 130 times, blocking key resolutions (Atlantic Council).
• Altered Global Order
◦ COVID-19 pandemic saw countries sourcing vaccines beyond traditional suppliers (WHO reports).
• Western Dominance
◦ Western nations influence decisions, IMF loans often favor Western economic models (IMF reports).
• Procedural Issues
◦ Lack of transparency and accountability in organizations like WHO, criticized for opaque COVID-19 origin probe.
• Backlash Against Globalization
◦ Events like Brexit, trade wars, and WTO’s dispute mechanism crisis reveal rising nationalism (WTO).

📍 Need for Reformed Multilateralism
✅ Adaptation to evolving geopolitics is essential for effective collaboration.
✅ Current crises—climate change, food security, economic disparities—are multifaceted.

📍 Conclusion
✅ NORMS aims to create a more representative, effective multilateral system.
✅ Adoption can better address emerging global challenges.

📝 GS-IV ETHICS — SHORT MODEL ANSWER

“Honesty as a policy always comes with a price…” Elaborate. Discuss the importance of honesty in civil services.

Introduction

Honesty means truthfulness, openness and straightforwardness in conduct. Though simple in principle, practising it often requires courage and sacrifice, especially when the system rewards convenience or compromise.

Why is honesty not easy?

🟢 Requires courage: An honest person must resist pressure, temptation and social expectations.

🟢 Creates conflicts: Straightforward conduct may lead to disagreements with colleagues, friends and even family.

🟢 Limited immediate rewards: Honest actions may not receive recognition and can sometimes invite criticism or professional difficulties.

🟢 Social isolation: Those unwilling to compromise with their values may be perceived as impractical or idealistic.

Importance in Civil Services

🟢 Public welfare: Honest decisions ensure that public resources and authority serve citizens rather than private interests.

🟢 Protection of vulnerable: Corruption in public works, for example, can directly harm the poor through unsafe infrastructure and poor service delivery.

🟢 Probity & integrity: Honesty strengthens constitutional values, fairness and accountability in administration.

🟢 Good governance: It builds public trust, improves work culture and encourages ethical conduct among subordinates.

🟢 Responsible use of power: Since civil servants exercise significant authority, honesty prevents misuse of power and promotes decisions based on public interest.

Conclusion
Honesty may demand personal sacrifice, but it strengthens self-respect, public trust and institutional integrity. Ethical leadership, transparency and accountability can help create an environment where honest conduct is protected and encouraged.
