The trial day began as usual at 9.15 am.

A new defence lawyer had joined the defence team in the morning, who was to shed light once again on the corporate law issues in the case of Dr. Reiner Füllmich and with whom further motions for evidence were to be prepared.
He is the AfA (Lawyers for Clarification) attorney Dr. Edgar Siemund.
The defense attorneys Katja Wörmer and Tobias Pohl went to Reiner Füllmich's cellar with their new colleague and discussed the case, which was new to him as he had not yet been given access to the files, and the special aspects of corporate law.
The defence lawyer Dr. Christof Miseré arrived a little late, waited in the courtroom for his colleagues and prepared himself for the trial day.
In addition, attorney Frank Groẞenbach was present again and now represented a new adhesion application for the donors of the Corona Committee.
After the defense lawyers had deliberated, especially with regard to the questioning of the present witness Prof. Dr. Martin Schwab, the witness questioning began at around 11.30 a.m.

Part 2
Punctual and present witness despite late summons

Prof. Dr. Martin Schwab appeared as a present witness after the summons to the hearing had reached him late - due to his prolonged absence for vacation and work.
The witness was initially questioned by the presiding judge. The questioning was permitted against the background of a special request for evidence by the defense.
In particular, he was to be questioned about a statement made by Viviane Fischer that she had already stated at the time that the donations were only ever held in trust for the donors themselves, in the escrow accounts, but never for the pre-UG, which had not come into existence.
In this respect, Viviane Fischer only ever felt a special obligation to the donors and close to them.
However, according to her own opinion, which also became clear through her application for adhesion, she did not feel responsible towards the non-existent pre-UG.
Witness Martin Schwab made it clear right at the beginning of his testimony that he had virtually no memory of the deliberations of the individual protagonists of the Corona Committee, but was unable to confirm Viviane Fischer's statement in particular.

He had been involved in mediation talks since the summer of 2022 and had also spoken to everyone individually about the issues surrounding the dispute at the time. However, he had not been able to prepare specifically for the hearing the day before and could therefore only answer questions in a very rudimentary way.
In principle, he could remember the term "liquidity reserve" being mentioned. However, he would rather attribute this term to Reiner Füllmich than to Viviane Fischer. He could also confirm that in the mediation discussions at the time, Reiner Füllmich had repeatedly affirmed that his loan amount had been secured by his property in Göttingen and that the loan was to be repaid from the purchase price as part of the sale of the property.

Part 3

Never a sham (loan agreement)

In his opinion, the term liquidity reserve and the term store of value were not mutually exclusive, but rather a liquidity reserve, which was to be held from the Corona Committee's donations, could also be secured in a property. There would therefore have been no contradictory meaning for him and he would not have been able to understand the dispute between Viviane Fischer and Reiner Füllmich at the time.
Furthermore, the witness confirmed that there had never been any discussion about the fact that the loan agreements had only been concluded as a sham. According to his recollection, there was only ever talk of loan agreements. Viviane Fischer had claimed in the mediation talks at the time that she had already repaid 70,000 euros from her loan. He had always tried to mediate between the individual protagonists and had hoped at the time that the whole matter could be resolved amicably.

However, the witness was unable to confirm Viviane Fischer's statement that she had said that the donations were held in trust accounts solely for the donors and not for the failed Vorschalt-UG. The witness apologized for the gaps in his memory and promised that if he was called to testify again, he would be better prepared for the next time. The hearing went on throughout the day, lasting until 3 p.m., without a break for the defense.
During the lunch break, new motions for additional evidence were drafted for the questioning of witness Martin Schwab, which were subsequently only partially admitted by the chamber.

Part 4

Money to which Reiner Füllmich is legally entitled

In the second part of the hearing, there was also the opportunity to show the witness Prof. Martin Schwab an email he had written to Reiner Füllmich in spring 2023, in which he had written

"Since I do not want to expose myself to the accusation of having participated in the embezzlement of your money or even having enriched myself with your money, I have paid the outstanding Green Mango invoices out of my own pocket."

When asked by the defense how this formulation was meant, the witness Schwab replied that he did not want to fall back on it until the final legal clarification of who was entitled to the money, as it was about the money that the complainant Marcel Templin had received in excess from the sale of Reiner Füllmich's house.

To explain: Marcel Templin had received an amount of 1.15 million euros from the sale of Füllmich's house, a considerable amount of which, in the opinion of the Economic Criminal Chamber, was obtained without legal grounds. This was established in a ruling. The defense of Reiner Füllmich even assumes that this was possibly a criminal act. Despite being requested to do so, Marcel Templin has still not returned the excess amount to Reiner Füllmich.

This amount, which Marcel Templin holds, was to be used to pay the costs of a legal dispute involving a karaoke bar in Berlin.
The witness Martin Schwab ultimately refrained from doing so because he assumed that it was money that Reiner Füllmich was legally entitled to, or that there was no final legal clarification of the money from the house sale and he therefore did not want to "enrich" himself with it.

The hearing of witnesses and the trial day ended at around 3 p.m., the next day of the trial is August 28, 2024, before the Göttingen Regional Court.
