๐Ÿ›ก๏ธ Meaning Of Judicial Activism

โ™Ÿ๏ธJudicial activism denotes the proactive role played by the judiciary in the protection of the rights of citizens and in the promotion of justice in the society. In other words, it implies the assertive role played by the judiciary to force the other two organs of the government (legislature and executive) to discharge their constitutional duties.

โ™Ÿ๏ธJudicial activism is also known as โ€œjudicial dynamismโ€. It is the antithesis of โ€œjudicial restraintโ€, which means the self-control exercised by the judiciary.
๐Ÿ›ก๏ธ Swaran Singh Committee

โ™Ÿ๏ธIn 1976, Congress Party set up the Sardar Swaran Singh Committee to make recommendations about fundamental duties, the need felt during the operation of the internal emergency (1975โ€“1977).

โ™Ÿ๏ธThe committee recommended the inclusion of a separate chapter on fundamental duties in the Constitution.

โ™Ÿ๏ธIt stressed that the citizens should
become conscious that in addition to the enjoyment of rights, they also have certain duties to perform as well.

โ™Ÿ๏ธThe Congress Government at Centre accepted these recommendations and enacted the 42nd Constitutional Amendment Act in 1976.

โ™Ÿ๏ธThis amendment added a new part, namely, Part IVA to the Constitution. This new part consists of only one Article, that is, Article 51A.

โ™Ÿ๏ธThough Swaran Singh Committee suggested eight Fundamental Duties in the Constitution, the 42nd Constitutional Amendment Act (1976) included ten Fundamental Duties.

*๐Ÿ›ก๏ธFast-track Courts*

โ™Ÿ๏ธ *Purpose* Established to address the backlog of criminal cases, especially heinous crimes against women and children.
โ™Ÿ๏ธ *Challenges:* Resource limitations, inefficient investigations, insufficient staff, and limited scope of jurisdiction.
โ™Ÿ๏ธ *Performance* Despite initial increase in functional courts, many states struggle to maintain them due to financial and administrative constraints.
โ™Ÿ๏ธNeed for Reform: States must prioritize their operation, ensure necessary resources, improve investigations, and leverage technology.

*๐Ÿ’ŽVisual Summary Analysis*

โ™Ÿ๏ธChart 1: Shows the increasing burden on the judiciary due to the rising number of criminal cases.
