🗞 SEC Celebrates Regulatory Milestone with GENIUS Act

🚀 The U.S. Securities and Exchange Commission (SEC) is heralding a significant shift in cryptocurrency regulation as the GENIUS Act moves closer to final approval by President Trump. SEC Chairman Paul Atkins described this legislative progress as a "pivotal step" in redefining digital finance and facilitating stablecoin integration.

👏 Atkins commended the House of Representatives for passing the GENIUS Act along with two other bills, acknowledging key figures such as Senate Banking Committee Chairman Tim Scott and Senator Cynthia Lummis for their leadership. He characterized the GENIUS Act as a "historic milestone" for crypto entrepreneurs, emphasizing its aim to provide legal clarity for payment stablecoins.

🔗 In his statement, Atkins underscored the transformative potential of blockchain technology:
Blockchain and crypto asset technologies have the potential to revolutionize America’s financial infrastructure and deliver new efficiencies, cost reductions, transparency, and risk mitigation for the benefit of all Americans.

He expressed optimism about the legislation offering the regulatory certainty needed for developers to innovate safely.

💡 Supporters of the new framework believe it strikes a balance between fostering innovation and managing risks, positioning the U.S. as a leader in crypto development. While some critics voice concerns about possible instability in digital asset markets, proponents argue that structured oversight is essential for promoting responsible growth in financial technology.

📈 Michael Saylor made headlines this week by acquiring an additional 6,220 BTC for approximately $739.8 million. This purchase comes after he hinted at it on Sunday, while his company, Strategy, already held around 601,550 BTC.

Strategy has acquired 6,220 BTC for ~$739.8 million at ~$118,940 per bitcoin and has achieved BTC Yield of 20.8% YTD 2025,

Saylor announced on X. He further detailed that as of July 20, 2025, they now hold 607,770 BTC acquired for about $43.61 billion at an average price of $71,756 per bitcoin.

🇺🇸 Trump's Trade Deal with Japan: Impact on Bitcoin and Stock Markets

📈 U.S. President Donald Trump announced a significant trade agreement with Japan, claiming it to be "perhaps the largest deal ever made." The deal involves a $550 billion investment from Japan into the U.S. and aims to enhance trade in automobiles and agricultural products between the two nations. Following this announcement, stock markets saw a positive response, with the S&P 500, Nasdaq, and Dow all experiencing gains. However, bitcoin (BTC) experienced a slight decline of 0.55%.

We just completed a massive Deal with Japan, perhaps the largest Deal ever made,

Trump stated on Truth Social.
Japan will invest, at my direction, $550 Billion Dollars into the United States, which will receive 90% of the Profits.

He further emphasized that the agreement would "create Hundreds of Thousands of Jobs" and noted that "There has never been anything like it."

📉 Despite the positive impact on stock markets, the broader cryptocurrency market faced challenges. It dropped by 1.20%, leading to a decrease in the Coinmarketcap Altcoin Season Index, which fell to 46 after peaking at 56 on Monday. This decline suggests that even a major trade agreement between two of the world's largest economies was insufficient to boost bitcoin's performance.

💰 At the time of reporting, bitcoin was priced at $118,203.22, reflecting a 0.77% decrease over 24 hours and a 0.88% drop since the previous week. Trading volume also fell by 11.52% to $67.28 billion, while bitcoin's market capitalization dipped slightly by 0.78% to $2.35 trillion. Despite these declines, bitcoin dominance increased by 1.10% to 61.57%.

🛠 India's Strategic Use of Data Analytics in Crypto Tax Enforcement

📊 India is leveraging advanced data analytics and forensic technology to combat crypto tax evasion, significantly boosting its digital asset revenue collection. Recently, in the Lok Sabha, Minister of State for Finance Pankaj Chaudhary reported on the taxation of virtual digital assets (VDAs) and cryptocurrencies. He highlighted that the tax implemented in the fiscal year 2022–23 under section 115BBH of the Income Tax Act yielded ₹269.09 crore (about $32 million) in its first year and increased to ₹437.43 crore in 2023–24.

🔍 While the government has not formally estimated losses from crypto income misreporting, it emphasized its commitment to using sophisticated surveillance methods. Chaudhary stated,
The government is utilizing data analytics tools to trace and detect tax evasion from VDA related transactions.

This includes employing the Non-Filer Monitoring System (NMS), Project Insight, and internal databases of the Income Tax Department. Although there is no centralized real-time matching system for income tax returns and Tax Deducted at Source (TDS) filings by Virtual Asset Service Providers (VASPs), retrospective analyses are conducted to identify discrepancies.

💰 India's approach to cryptocurrency taxation is rigorous, imposing a flat 30% income tax on VDA transfer gains with no deductions allowed except for acquisition costs. A 1% TDS applies to VDA transfers above certain thresholds to monitor transactions. Recently, the international crypto exchange Bybit announced it would impose an 18% Goods and Services Tax (GST) on service fees for Indian users, aligning with local laws.

👨‍🏫 In addition to these measures, the government is enhancing training for its enforcement personnel. Chaudhary explained,
Several capacity-building initiatives are being undertaken by the government to equip officers for effective compliance monitoring and investigation of VDA related transactions.

Various training programs, workshops, and hands-on sessions are regularly conducted to improve skills in digital forensics, blockchain analysis, and legal frameworks. Partnerships with institutions like the National Forensic Science University in Goa further support these efforts by offering short-term courses in digital forensics.

💰 U.S. Authorities Target $2.4 Million in Bitcoin Linked to Ransomware Syndicate

⚖️ The U.S. Department of Justice (DOJ) has initiated a civil forfeiture action to seize over $2.4 million in bitcoin associated with a significant ransomware syndicate. This move follows the FBI's seizure of 20.2891382 BTC from a specific cryptocurrency address on April 15, 2025, which was valued at more than $1.7 million at the time but has since appreciated in value.

🔗 The DOJ's complaint, filed in the Northern District of Texas, links the seized bitcoin to a wallet controlled by an individual known as "Hors", who is believed to have ties to the Chaos ransomware group. This group has been implicated in cyberattacks against various victims, including those in Texas. The department asserts that the cryptocurrency either represents proceeds from criminal activities or assets utilized to facilitate such activities.

The seized cryptocurrency, now valued at over $2.4 million, allegedly constitutes property involved in unlawful activity, or proceeds of or property derived from unlawful activity, including money laundering and extortion related to damage to a protected computer, commonly referred to as a ransomware attack.

👩‍⚖️ Nancy E. Larson, the acting U.S. attorney for the Northern District of Texas, emphasized the department's commitment to using civil forfeiture as a means to disrupt the financial operations of cybercriminals. The seizure was carried out by the FBI's Dallas team following thorough blockchain tracing efforts.

💡 While critics often highlight the potential for digital currencies to facilitate illicit activities, supporters argue that they also provide legitimate benefits such as cross-border transactions and greater financial autonomy for individuals.

📉 Bitcoin ETFs Experience Major Outflows While Ether ETFs Continue to Thrive

🔄 Bitcoin exchange-traded funds (ETFs) experienced a significant setback with outflows totaling $115 million after a period of steady gains. In contrast, ether ETFs maintained their impressive performance with a modest inflow of $17 million.

📉 On Thursday, July 31, a shift in market sentiment impacted bitcoin ETFs, ending their recent positive streak. Blackrock’s IBIT saw an addition of $18.62 million, and Franklin’s EZBC, Grayscale’s Bitcoin Mini Trust, and Invesco’s BTCO collectively contributed nearly $16 million. However, Ark 21shares’ ARKB suffered a loss of $89.92 million, followed by Fidelity’s FBTC with $53.63 million and Grayscale’s GBTC shedding $9.18 million. Despite five ETFs recording inflows, the overall outflows led to a deep decline.

📈 In contrast, ether ETFs continued their upward trajectory, marking their 20th consecutive day of inflows with an addition of $17 million. Blackrock’s ETHA was the leader with $18.18 million, while Fidelity’s FETH contributed $5.62 million. Although Grayscale’s ETHE experienced a slight outflow of $6.80 million, it did not disrupt the overall positive trend for ether ETFs.

📊 Two distinct narratives are emerging from these developments: bitcoin ETFs are facing challenges after significant institutional activity earlier this month, while ether ETFs demonstrate consistent performance, indicating strong investor confidence in ETH.

🚨 Brazilian Congress Faces Urgent Decision on Crypto Taxation

📰 The Brazilian Congress is at a critical juncture regarding cryptocurrency taxation, as it prepares to discuss a new scheme imposed by President Luiz Inácio Lula da Silva. This scheme, which some critics deem illegal due to its extensive reach, proposes to tax decentralized finance activities and self-custodied assets.

⚖️ The proposed taxation could impact every cryptocurrency holder and trader in Brazil, potentially stifling the usage and adoption of digital assets. Ironically, while it threatens to burden small traders, it reduces tax rates for large crypto holders, lowering percentages from 20% and 22% to 17.5%.

What might be even worse is that the measure could send cryptocurrency users underground, affecting the viability of cryptocurrency companies in Brazil and incentivizing a secrecy-based crypto culture.

🤝 Despite the lack of consensus among lawmakers, some have already proposed legislation to repeal these measures if they are approved by Congress. The outcome of this debate will significantly influence the future of the cryptocurrency industry in Brazil and the use of digital assets as a savings tool.

🙏 It is hoped that lawmakers will reject this hasty cash-grab taxation system and initiate a serious discussion for a more reasonable and less disruptive approach.

💹 Ethereum Approaches $4K Amid Record Futures Open Interest

📈 On August 8, 2025, Ethereum's (ETH) market capitalization reached $470.8 billion, accounting for 12.2% of the $3.87 trillion cryptocurrency market. The past 24 hours saw $32.5 billion in ETH trades, with prices fluctuating between $3,806 and $3,972. This price surge resulted in significant derivatives liquidations totaling $103.10 million in ETH positions, primarily from short bets.

📊 The 4-hour chart indicates a rebound from $3,351 on August 3 to nearly $3,972, showcasing a consistent upward trend with high-volume breakout candles. ETH has risen from $2,475 in late July, overcoming minor resistance levels as it approaches the $4,000 threshold.

📉 Futures open interest for ETH has hit a record $52.19 billion (13.38 million ETH), with the largest shares on CME, Binance, and Bybit. Recent changes in open interest over the last 24 hours show increases for CME (+6.71%), Binance (+1.87%), and Bybit (+3.42%), while OKX, Gate, and KuCoin experienced declines. The OI-to-volume ratio is highest on CME at 1.6627, indicating strong institutional positioning.

📈 In the options market, total open interest leans towards calls at 67.46% (2.045 million ETH) compared to 32.54% in puts. Over the past day, calls represented 57.11% of trading volume (288,565 ETH), while puts made up 42.89% (216,753 ETH). The most significant ETH options by open interest include the December 26, 2025 $6,000 calls (60,644 ETH) and the September 26, 2025 $4,000 calls (54,738 ETH).

🔮 With both futures and options markets displaying strong call interest, the derivatives landscape suggests a bullish outlook as the year’s final quarter approaches. However, the high open interest and recent liquidation activity could lead to increased volatility if price momentum shifts.

🗞 Historic Executive Order Opens 401(k) Plans to Alternative Investments

📅 On August 7, 2025, the White House announced a significant executive order titled “Democratizing Access to Alternative Assets for 401(k) Investors,” allowing U.S. retirement savers to invest a portion of their 401(k) accounts in alternative assets like private equity, real estate, and cryptocurrencies. This marks a pivotal shift for over 90 million Americans who can now access these investment options through employer-sponsored savings plans.

🔑 Traditionally, 401(k) plans have been limited to conventional investments such as stocks, bonds, and mutual funds. The new policy acknowledges the potential of alternative assets for diversification and growth for everyday investors. Opening the $9 trillion 401(k) market to cryptocurrencies could transform individual portfolios and the broader blockchain economy.

📜 The executive order outlines several regulatory actions to be implemented within 180 days:

1. Reexamination of ERISA Guidance: The Secretary of Labor will review existing guidance on fiduciary duties related to alternative assets, considering the rescission of a 2021 statement that imposed limits on private equity investments.

2. Clarification of Fiduciary Standards: The Secretary will clarify the Department of Labor's position on alternative assets, establishing criteria for weighing higher fees against long-term returns and proposing rules to reduce uncertainty over fiduciary duties.

3. Interagency Coordination and SEC Involvement: The DOL will collaborate with the Treasury Department and SEC to ensure consistent rules and explore regulatory changes to broaden access to alternative assets in retirement plans.

⚖️ While this policy opens up new opportunities, it also imposes heightened fiduciary responsibilities on plan sponsors. Alternative assets, particularly cryptocurrencies, can be volatile and complex. Sponsors must implement rigorous due diligence processes, set allocation limits, and provide clear disclosures to participants.

💡 At Kelman PLLC, we see this executive order as a turning point in retirement investing and digital asset regulation. Plan sponsors and asset managers should prepare by developing compliant product offerings and participant education programs. With 90 million Americans potentially gaining exposure to cryptocurrencies through their retirement accounts, the intersection of digital assets and long-term savings is now a critical area in financial law.

🚨 Google Play Store's Policy Update Sparks Crypto Community Outrage

🛑 In July 2025, a seemingly minor update to the Google Play Store's policy led to significant backlash from the crypto community. The update inadvertently banned all non-custodial crypto wallets from the platform, prompting Google to clarify that these wallets do not need to be licensed as banks or registered money services businesses (MSBs).

📅 The controversy began when The Rage published an article highlighting a new policy that would require all crypto wallets in the Google Play Store across 15 jurisdictions, including the U.S. and EU, to have government licensing. This policy failed to distinguish between custodial wallets, which store cryptocurrency on behalf of customers, and non-custodial wallets, which allow users to maintain full control over their assets.

Thanks for flagging this,

Google responded on X.
Non-custodial wallets are not in scope of Google Play’s Cryptocurrency Exchanges and Software Wallets Policy. We are updating the Help Center to make this clear.

😡 The initial wording of the policy angered crypto legal experts and privacy advocates, who criticized it as
regulation by monopoly

and
a quiet coup on crypto.

The uproar prompted Google to promise a revision of the policy, which helped to quell the controversy.

🌍 XRP Ledger: A Model for Global Financial Infrastructure

🚀 The XRP Ledger (XRPL) is being recognized as a leading model for global financial infrastructure, thanks to its scalability, real-world utility, and institutional-grade design developed over the past decade. Ripple's Chief Technology Officer, David Schwartz, emphasized this on August 13, highlighting the trend of stablecoin and payment companies creating their own blockchains as a sign of growing acceptance of blockchain as essential financial infrastructure.

The XRPL has real traction and institutional adoption because it’s been battle-tested, updated, and improved upon for well over a decade,

Schwartz stated. He pointed out that unlike other chains that depend on permissioned validator sets managed by centralized entities, which can limit scalability and openness, XRPL provides a hybrid model. It is primarily public and permissionless but includes features to support compliance in regulated environments.

💸 Schwartz explained that XRPL facilitates efficient and low-cost transactions:
You can pay directly in XRP for any issued asset, avoiding the friction and hidden costs of buying another token just to transact. XRP is counterparty-free, accessible by all, and used as a bridge asset with real utility for payments, settlement, and liquidity.

He also noted that core design choices made by XRPL, such as deterministic finality and Proof of Authority-based consensus, are being increasingly adopted by newer platforms. This suggests a growing consensus on best practices for blockchain-based financial infrastructure.

🔮 Looking ahead, Schwartz expressed anticipation for the next phase of XRPL innovations:
bringing more programmability, compliance-grade capabilities, and deeper liquidity for institutional use.

🚀 Wyoming Launches America's First State-Backed Stablecoin Across Seven Blockchains

🌟 On August 19, the Wyoming Stable Token Commission announced the mainnet launch of the Frontier Stable Token (FRNT), making Wyoming the first U.S. public entity to issue a blockchain-based stable token. This historic event positions Wyoming at the forefront of digital finance.

FRNT is designed to provide secure, transparent, and efficient digital transactions for individuals, businesses, and institutions – worldwide,

the announcement stated. Governor Mark Gordon, who chairs the commission, highlighted Wyoming's leadership in blockchain regulation, noting that the state has passed over 45 pieces of legislation related to digital assets since 2016.

🛡 Established under the Wyoming Stable Token Act in March 2023, the commission is responsible for issuing fully collateralized stable tokens with strict fiscal oversight. The FRNT token is fully backed by U.S. dollars and short-duration treasuries, with a 2% overcollateralization buffer mandated by state law.

🔗 To ensure security and compliance, the commission collaborated with several partners: LayerZero for issuance, Fireblocks for infrastructure, Franklin Advisers for reserve management, Inca Digital for intelligence services, and The Network Firm for audits.

📅 Distribution plans were also detailed, with FRNT set to be available for purchase on the Solana blockchain through the Wyoming-based digital asset exchange Kraken and on Rain’s Visa-integrated card platform on the Avalanche blockchain. The token has been deployed across seven blockchains: Arbitrum, Avalanche, Base, Ethereum, Optimism, Polygon, and Solana.

🚀 Kraken Integrates Distributed Validator Technology for Ethereum Staking

🔗 Kraken has become the first major cryptocurrency exchange to fully integrate distributed validator technology into its Ethereum staking infrastructure using the SSV Network. This deployment significantly enhances the security and reliability of its staking services.

🔐 The SSV Network’s Distributed Validator Technology decentralizes validator operations by splitting the validator key into secure shares distributed across a group of independent nodes. These nodes collaborate to perform duties like block proposing and attesting, eliminating reliance on a single machine. This architecture aims to provide higher fault tolerance and improved uptime. Kraken stated it also offers stronger protection against slashing risks caused by hardware or client-level failures by introducing geographic and client diversity.

This milestone reflects Kraken’s longstanding commitment to technical excellence and operational security,

said Jonathan Marcus, Head of Strategy, Custody and Staking. He noted the deployment has
fundamentally improved the performance reliability

of its validators.

🤝 Alon Muroch, founder of SSV Labs, stated the integration enables clients to
securely participate in staking while actively supporting the Ethereum network.

The move aligns with Ethereum’s broader goal of reducing central points of failure within its consensus layer. It allows Kraken to scale its enterprise-level staking operations without a proportional increase in operational risk. The technology is now active across all of Kraken’s Ethereum staking infrastructure.

🇺🇸 U.S. Stake in Intel: A Step Towards Socialism?

🤔 A recent deal by the Trump Administration has stirred controversy by acquiring a 9.9% stake in Intel for $11.1 billion. This move, aimed at bolstering the U.S. national chip industry, has sparked debates about the extent of government involvement in private businesses. Critics, including Senator Rand Paul, have labeled it as "close to socialism".

If socialism is government owning the means of production, wouldn’t the government owning part of Intel be a step toward socialism? Terrible idea.

📉 Kevin O’Leary, a supporter of Trump, also opposed the deal, arguing that it contradicts the American business model. He emphasized the importance of keeping government and private sector operations separate for over 200 years.

What has made America so great for 200 years is the government stays in its lane, and the private sector does what it does so successfully.

In defense of the investment,
President Trump
dismissed critics as
"stupid"
and asserted that the deal would create
more jobs in America
. He claimed, I PAID ZERO FOR INTEL, IT IS WORTH APPROXIMATELY 11 BILLION DOLLARS. All goes to the USA.

🔮 Trump also hinted at the possibility of pursuing similar deals in the future, suggesting a potential increase in state participation in capital markets. However, he did not provide specifics on which businesses might be targeted for such investments.

⚠️ Former PBOC Governor Warns Against Yuan-Based Stablecoins

🗣 Zhou Xiaochuan, the former governor of the People’s Bank of China (PBOC), has expressed concerns regarding calls for the Chinese government to permit the issuance of yuan-based stablecoins. He cautioned that speculation in these assets could threaten financial stability. Zhou, who held the position from 2002 to 2018, also noted that stablecoins provide limited cost benefits compared to China's "efficient" retail payment systems.

📅 These remarks were made during a closed-door meeting in July but were only revealed later by the Beijing-based economic think tank CF40 on August 27. Zhou's warning comes amid rising apprehension among China's financial elite about the dominance of U.S. dollar-backed stablecoins in perpetuating the greenback's hegemony.

🇺🇸 Recently, U.S. lawmakers passed two stablecoin bills — the Guiding and Establishing National Innovation for U.S. Stablecoins (GENIUS) Act of 2025 and the Clarity for Payment Stablecoins Act of 2024. These laws require stablecoin issuers to back their digital assets with U.S. Treasuries, seen as a move to extend the dollar's dominance in the digital space and strengthen the United States' control over the global financial system. In response, some corporations are urging Beijing to allow them to issue stablecoins backed by the yuan.

💰 While acknowledging the potential of digital currencies, Zhou challenged the notion that traditional cross-border payment systems are "very expensive," describing such claims as exaggerated. He stated,
In reality, many of the cost factors aren’t technical, but rather relate to foreign exchange controls, which are linked to numerous institutional issues such as the balance of payments, exchange rates, and monetary sovereignty.

However, he agreed that stablecoins could be beneficial in situations where a country's currency is failing and dollarization becomes necessary.

⚠️ Zhou also pointed out that some issuers may not genuinely be interested in the stablecoin business but rather seek to leverage its popularity to enhance their own valuations. He warned that this could be harmful to the healthy development of the entire financial system and might lead to the accumulation of systemic risks.

⚠️ Hunter Beast Warns About Bitcoin's Vulnerability to Quantum Computing

🔍 Hunter Beast, the author of BIP 360, which aims to make bitcoin resistant to quantum computing, has expressed growing concerns about advancements in this field that could threaten bitcoin's security. He stated,
I don’t think we have as much time as I once thought.

🗣 While many analysts have downplayed the immediate threat of quantum computing to bitcoin, Beast emphasized the urgency of addressing this issue. He refrained from disclosing specific details about his concerns but urged for increased awareness regarding the potential dangers.

⏳ Beast established a hypothetical timeline for when this threat could become effective, stating,
Worst case? Absolute worst case is that we have 3 years.

He clarified that this was not meant to incite fear but rather to motivate action.

🤔 Ethereum co-founder Vitalik Buterin also weighed in on the matter, suggesting there is a 20% chance that quantum methods could break bitcoin encryption by 2030. In response to these concerns, El Salvador recently announced plans to redistribute its national bitcoin reserve to new addresses as a precaution against potential quantum attacks.
