• Threats of Prison: Bertino alleges he was threatened with 25 years in prison unless he altered his initial, truthful proffer—that the events of January 6 were organic and unorganized—to fit the government's planned conspiracy narrative.

• Constitutional Violations: The filing argues that the government’s knowing use of altered testimony and failure to disclose the coercive tactics constitute clear violations of Rehl's Fifth Amendment Due Process rights, specifically citing Napue v. Illinois and Brady v. Maryland.
