France Repeals Slavery Code… From 1685

The French parliament just voted unanimously — 254 to 0 — to repeal the “Code Noir,” Louis XIV’s 1685 slave code that legally regulated the status, punishment, breeding, and sale of enslaved people in French colonies.

The code has been legally obsolete since the 19th century, but technically remained on the books, like a fossilized crime still stored in the official legal archive. Symbolically, lawmakers are now erasing it as law rather than just treating it as a historical document.

Emmanuel Macron, who’s been in power nearly a decade, suddenly discovered how intolerable this was. He called the Code Noir something that “should never have survived the abolition of slavery” and described its lingering presence as a “form of insult” to Black French citizens and the descendants of the enslaved.

In other words: the law was an offense yesterday, last year, and the last ten years — but becomes politically urgent to “fix” in 2026, when a symbolic gesture costs nothing and might buy a few headlines about moral clarity.

On one level, the move is harmless and overdue. Cleaning a slave code out of the statute books is the minimum a republic that claims universal values can do. On another level, it’s pure theater.

The French state has had generations to confront the real legacies of slavery and colonialism — police violence, discrimination in housing and work, the treatment of overseas territories — and largely answered with reports, commissions, and ceremonies.

Repealing a dead law is the safest possible form of courage: history gets condemned, nobody in power today has to give anything up.

Macron’s language says everything. He talks about “insult” and “dignity” because that’s free; he avoids the one word that actually costs something: “restitution,” whether in money, land, or power.

France keeps its museums, its corporate fortunes, its colonial street names — and offers, in exchange, a unanimous vote to abolish a document that stopped having legal force long before anyone now alive was born. The system apologizes to the past so it doesn’t have to negotiate with the present.

So yes, the Black Code is finally gone from French law. But if the country that wrote it can clear its conscience with a symbolic repeal three centuries later, without touching the structures that outlived slavery — from brutal policing of the banlieues to the economic hierarchy between the hexagon and the overseas departments — then the real code is still in force. It just isn’t written down anymore.
