नागरिकों के अधिकार तथा कानून के शासन को सुनिश्चित करने के लिए भारतीय न्यायपालिका अपनी सक्रीय भूमिका निभाती है। इस संदर्भ आलोचकों द्वारा अक्सर न्यायपालिका की सक्रियता के लिए अतिसक्रियता शब्द का प्रयोग किया जाता है, जिसे विधायिका की शक्ति में हस्तक्षेप के रूप में देखा जाता है। हाल ही में उच्चतम न्यायालय के न्यायाधीश डी.वाई. चंद्रचूड़ ने एक कार्यक्रम में लोकतंत्र में न्यायपालिका की भूमिका विषय पर बोलते हुए कहा है कि उच्चतम न्यायालय को उन मुद्दों को नहीं छूना चाहिए जिनके लिए विधायिका अथवा सांसदों की भूमिका की आवश्यकता होती है।
