🚨 SUPREME COURT | IMPORTANT JUDGMENT

🌐 Internet Access is a Fundamental Right — Even for Children

The Supreme Court has held that the right to access and use the internet is a fundamental right of every individual, including children.

📌 Constitutional Basis:
Article 21 + Article 19(1)(a)

⚖️ Key Observations:
• The Court refused to impose a blanket age-based ban on children’s internet access.
• Children enjoy fundamental rights irrespective of their age.
• The Court emphasised that children’s safety and freedom are not conflicting interests.
• Instead of blanket bans, the Court called for parental controls, child-mode features and stronger safeguards on social media platforms.
• The Centre was directed to develop mechanisms for detecting and removing Child Sexual Exploitation and Abuse Material (CSEAM).

📚 Why is this important for Law Aspirants?

This judgment connects Article 21, Article 19(1)(a), Right to Digital Access, Right to Privacy and Children’s Rights.

🔥 Must Remember:
Internet Access → Fundamental Right → Article 21 read with Article 19(1)(a)

⚖️ Just Rights for Children Alliance & Anr. v. S. Harish & Ors.
