1. Does the CAB Bill affect Indians(Hindus, Muslims, anyone)?
Ans. No. It has nothing to do with Indians in any way

2. Whom does it apply to?
Ans. Only to Hindus, Sikhs, Jains, Buddhists, parsis & Christians from 3 countries, who are facing religious persecution in those countries AND who are already in India before 1st Dec 2014.

3. Which 3 countries?
Ans. Pakistan, Bangladesh & Afghanistan

4. In what way does it benefit Hindus, Sikhs, Jains,Buddhists, parsis & Christians from these 3 countries?
Ans. Their residency requirement has been reduced from 11 to 5 years. And they can claim citizenship as a right under this law

5. Does this mean that Muslims from these 3 countries can *never* get Indian citizenship?
Ans. No. But they will go thro’ the usual process of acquiring citizenship thro’ naturalization rules….11 years of residence etc.

6. Will illegal muslims immigrants from these 3 countries be automatically deported under this bill?
Ans. No. The usual process applies. Their application for naturalisation as citizens will be as per the governing law and based on demerits of the case

7. Can Hindus facing persecution in other countries apply under this law?
Ans. No

8. Does this bill apply to other forms of persecution – Political, racial, sexual etc?
Ans. No. The bill is very specific in its intent – religious persecution of above notified minorities in these 3 countries

9. Why only these 3 countries ? And why only religious persecution of above Notified denominations?
Ans. These 3 countries have a track record of pervasive, systematic & institutionalized persecution of minority Hindus, Sikhs, Jains, Buddhists, parsis & Christians especially the perennial persecution in Pakistan

10. What about Sri Lankan tamils?
Ans. (1) The war has been over for the a decade now. (2) There never was any persecution on religious lines. It was on racial faultlines. And over the decades of civil war, the Sri Lankans have put an end to institutionalized discrimination of Tamils

11. Doesn’t India have an obligation under the UN to take care of refugees?
Ans. Yes it does. And it is not shying away from it. But it has no obligation to offer citizenship. Each country has its own rules for naturalization. India is not going to turn away other refugees under this law. It will play host to them under UN rules, in the implicit expectation that some day they will return to their homelands when the conditions improve. But in the case of Minorities from these 3 countries, this law acknowledges the reality that the environment of persecution in these 3 countries is never going to improve

12. Why shouldn’t Baluchis, Ahmediyas in Pakistan, Rohingayas in Myanmar not be considered for this kindness?
Ans. They will be considered under the existing laws. Not under the special category

नागरिकता संशोधन विधेयक ( Citizen Amendment Bill ) को लोकसभा के बाद अब राज्यसभा से भी मंजूरी मिल गई। राष्ट्रपति की मुहर लगने के बाद अब नागरिकता संशोधन विधेयक कानून बन गया है। संसद ने बुधवार को नागरिकता संशोधन विधेयक को मंजूरी दे दी जिसमें अफगानिस्तान, बांग्लादेश और पाकिस्तान से धार्मिक प्रताड़ना के कारण भारत आए अल्पसंख्यक(हिन्दू, सिख, बौद्ध, जैन, पारसी और ईसाई )समुदायों के लोगों को भारतीय नागरिकता प्रदान करने का प्रावधान है। राज्यसभा ने बुधवार को विस्तृत चर्चा के बाद इस विधेयक को पारित कर दिया। सदन ने विधेयक को प्रवर समिति में भेजे जाने के विपक्ष के प्रस्ताव और संशोधनों को खारिज कर दिया। विधेयक के पक्ष में 125 मत पड़े जबकि 105 सदस्यों ने इसके खिलाफ मतदान किया। बता दें कि लोकसभा इस विधेयक को पहले ही पारित कर चुकी है।

नागरिक संशोधन बिल के कानून का रूप लेने से पाकिस्तान, अफगानिस्तान और बांग्लादेश में धार्मिक उत्पीड़न के कारण वहां से भागकर आए हिंदू, ईसाई, सिख, पारसी, जैन और बौद्ध धर्म को मानने वाले लोगों को CAB के तहत भारत की नागरिकता दी जाएगी। अब समझ में ये नही आ रहा कि इससे किसी एक धर्म के लोगों के पेट में दर्द क्यों उखड़ गया है ।

(जबकि कई प्रताड़ित मुस्लिम जैसे अदनान स्वामी,तारिक फतह जैसे मुसलमान और भी लीगल तरीके से भारत मे पासपोर्ट वीसा ले कर रह सकते है)

नागरिकता संशोधन बिल के चलते जो विरोध की आवाज उठी उसकी वजह ये है कि इस बिल के प्रावधान के मुताबिक पाकिस्तान, अफगानिस्तान और बांग्लादेश से आने वाले मुसलमानों को भारत की नागरिकता नहीं दी जाएगी। कांग्रेस समेत कई पार्टियां इसी आधार पर अपवाह फैला करबिल का विरोध कर रही हैं। अब असल में पेट दर्द का अपच कारण तो ये है । आखिर जब धर्म के आधार पर देश का बंटवारा पहले कांग्रेस कर चुकी है तो इस बिल से कांग्रेस को ही दिक्कत क्यों? बात बात पर तो कांग्रेसी नेता और सेक्यूलरिज्म का चोला ओढ़े धर्म विशेष के लोग कहते आए है कि भारत में मुसलमान सुरक्षित नही हैं । तो फिर भाई सुरक्षित देश से असुरक्षित देश में मुसलमानों को लाने की आतुरता आखिर विपक्ष को क्यों है? देश के पूर्वोत्तर राज्यों में इस विधेयक का विरोध किया जा रहा है, और उनकी चिंता है कि पिछले कुछ दशकों में बांग्लादेश से बड़ी तादाद में आए हिन्दुओं को नागरिकता प्रदान की जा सकती है। अब मुसलमानों के झुठे रहनुमों को चिंता सता रही है कि हिंदूओं के वोट प्रतिशत बढ़ जाने से मेरे कुर्सी का क्या होगा रे रामा ? गृह मंत्री अमित शाह ने तो साफ कह दिया है कि भारत के मुसलमान भारतीय नागरिक थे, हैं और बने रहेंगे। तो फिर भारतीय मुसलमान आखिर क्यों इस तरह के कमेंट कर रहे है? या तो ये वहीं मुसलमान है जिनको अब यहाँ से टिकट कटती नजर आ रही है या फिर ये वो लोग है जिन्हें कुर्सी के लिए कांग्रेस जैसे पार्टी के लोग हमेशा उकसाते आए है । पाकिस्तान , बंग्लादेश और अफगानिस्तान में अल्पसंख्यकों की आबादी में खासी कमी आयी है जबकी भारत के अल्पसंख्यकों में बेहताशा वृद्धि हुई है । आखिर अप्रत्याशित वृद्धि कैसे ? साफ है कि टीएमसी जैसे पार्टी बंगाल में बंग्लादेशी को वोटर बनाकर अपना उल्लू सीधा करती है जिस पर अब काले बादल मंडराते नजर आ रही है ।

कांग्रेस , टीएमसी , सपा , राजद , एनसीपी , माकपा , टीआरएस , डीएमके , बसपा , आप के अलावा मुस्लिम लीग, भाकपा और जेडीएस जैसी दल इस विधेयक का पुरजोर विरोध कर रही है । ये ऐसे दल है जो देश में मुसलमानों को वोट बैंक के तौर पर युज करती आयी है
। कई ऐसे दल है जो माय बाप समीकरण के तहत इन समुदाय के लोगों में विष घोलते आए है । अब जब इन सबों पर शाह का हंटर चला है तो बौखलाहट तो लाजमी होगा ।

Without Government intervention, this solution couldn't have been possible, particularly we are thankful to S. Hardeep Singh Puri, who responded to our tweets and took up our matter in Law and Justice Ministry to improve IBC as per needs of Home Buyers, 2 times, and IBC was amended in favour of Home Buyers 2 times, first to grant Home Buyers Financial Creditors Status and Second when Home Buyers 58% votes to be treated full vote, even if 11000 votes casted out of 22600 votes, if these two amendments were not brought by Law Ministry this solution couldn't have been possible. “Further, notwithstanding anything contained in this Resolution Plan the Resolution Applicant or the Corporate Debtor shall have no obligation or liability towards the Homebuyers on account of monies paid by the Home buyers to JAL (either directly or indirectly, including payments made through JIL) towards maintenance charges or interest free maintenance deposits (IFMS/IFMD). It is also clarified for avoidance of doubt that the Home Buyers shall not be entitled to set off/adjust any such monies paid towards maintenance charges from any of the amounts due to the Corporate Debtor.”  
 
The OOP demand letter raised by JAL/JIL includes payment demands to be made towards maintenance charges and interest free maintenance deposits (IFMS/IFMD), which the Home Buyers shall not be entitled to set off/adjust from any of the amounts due to the Corporate Debtor.
 
 
3. Further, the National Company Law Tribunal (NCLT) on March 3, 2020 approved the proposal of NBCC (Resolution Applicant) to acquire Jaypee Infratech Limited (JIL).
 
 
4. In light of all of the above, all future dealings/payments related to my apartment are proposed to be taken up with NBCC directly. Until then, kindly note that any charges on account of interest, holding or maintenance, if levied against my apartment, shall be illegal and unlawful.
