It is a settled principle of the constitution of India that the expression “law” is not confined to legislative enactments alone. Article 13(3)(a) of the Constitution of India expressly includes ordinances, orders, bye-laws, rules, regulations, notifications, and customs or usages having the force of law within its scope. However, whether a particular Government Order, administrative circular, executive instruction, or other instrument constitutes “law” depends upon its statutory source, legal character, and the constitutional provision under consideration. An executive instruction cannot, merely by virtue of its issuance by a Government authority, automatically be equated with a law having statutory force.

அரசமைப்பு சாசனத்தின் நிலைபெற்ற கோட்பாட்டின்படி, “சட்டம்” (Law) என்ற சொல் சட்டமன்றங்களால் இயற்றப்படும் சட்டங்களுக்கு மட்டுமே வரையறுக்கப்படுவதில்லை. இந்திய அரசமைப்பின் உறுப்பு 13(3)(a), அவசரச் சட்டங்கள் (Ordinances), ஆணைகள் (Orders), துணைச் சட்டங்கள் (Bye-laws), விதிகள் (Rules), ஒழுங்குமுறைகள் (Regulations), அறிவிப்புகள் (Notifications) மற்றும் இந்தியப் பிரதேசத்தில் சட்டத்தின் வலிமையைக் கொண்டுள்ள பழக்கவழக்கங்கள் அல்லது நடைமுறைகள் (Customs or Usages) ஆகியவற்றையும் “சட்டம்” என்ற வரையறைக்குள் வெளிப்படையாக உள்ளடக்குகிறது. இருப்பினும், ஒரு குறிப்பிட்ட அரசாங்க ஆணை (Government Order), நிர்வாகச் சுற்றறிக்கை (Administrative Circular), நிர்வாக அறிவுறுத்தல் (Executive Instruction) அல்லது பிற ஆவணம் “சட்டம்” எனக் கருதப்படுமா என்பது, அதன் சட்டபூர்வமான அடிப்படை, அதன் சட்டத் தன்மை மற்றும் அது தொடர்புடைய அரசமைப்பு உறுப்பு ஆகியவற்றைப் பொறுத்து அமையும். அரசாங்க அலுவலரால் வெளியிடப்பட்டது என்ற ஒரே காரணத்திற்காக, ஓர் நிர்வாக அறிவுறுத்தலைச் சட்டப்பூர்வமான வலிமையைக் கொண்ட சட்டத்திற்கு இணையானதாகத் தானாகவே கருத முடியாது.
