Some attorneys suggest filing NPT with back date in this case:

1. H1B lay off. Filed H1B->B2 COS.
2. Filed H1B Transfer after 60 days with NPT option (that's quite aggressive!!) By completely ignoring pending B2.

S386 news today – Dick Durbin is stuck on his own bill to give age-out protection for H4 kids.

He announced this bill (Protect Children of Immigrant Workers Act) on July 21 in Senate.

He is planning for a unanimous consent voting at 4 PM ET on July 22 (Unconfirmed reports).

My Opinion:
#S386 is back to square one at this time with no real chance of passing in the near future (at least till elections).

The S386 bill will expire in the new Senate that will start in Jan 2021.
This means that everything will have to be restarted and the bill will have to be reintroduced with a new number.

ImmigrationVoice reported that Durbin has shown interest in re-negotiating the S386 deal.

We do not know if this will work out or not.

If it does, then it should be close or similar to the earlier deal.

Trump signed a new H1B executive order today.
- Will make H1B hiring difficult for federal government company projects.
- LCA and PERM for these projects might be denied.
