Today marks 51 years of the Kesavananda Bharati case.
Keshavananda Bharati Case (1973)
✍️In this case, the Supreme Court reversed its decision in the Golak Nath case. It upheld the validity of the 24th Amendment Act and said that Parliament has the right to abridge or take away any fundamental right.
✍️Also, it laid down a new doctrine of the 'basic structure' (or 'basic features') of the Constitution.
It ruled that the constituent power of Parliament under Article 368 does not enable it to change the 'basic structure' of the Constitution.
✍️This means that Parliament cannot abridge or take away any fundamental right which is part of the 'basic structure' of the Constitution.
