[인도 대법원, 인도준비은행 암호화폐 금지령에 '위헌' 판결]


인도 암호화폐 전문 법률기관 크립토 카눈(Crypto Kanoon)에 따르면 인도 대법원이 인도준비은행(RBI; Reserve Bank of India) 암호화폐 금지령을 취소하라는 판결을 내렸다. 인도 대법원은 RBI의 암호화폐 금지령이 위헌 소지가 있다고 봤다. 앞서 보도에 따르면 RBI는 2018년 4월 현지 은행에 암호화폐를 거래하는 개인, 기업을 대상으로 서비스 제공을 중단하라고 명령했다. 이에 인도 암호화폐 거래소는 반발하며 정부를 상대로 소송을 제기했다. 원고는 비영리단체인 인터넷모바일협회(IAMAI)다. IAMAI는 RBI의 조치는 사실상 가상화폐를 통한 합법적인 사업을 금지한 셈이라고 주장해왔다.

코인데스크에 따르면, 전 EY 인도 블록체인 담당자 Tanvi Ratna가 최근 인도 최고법원의 암호화폐 금지령 부당 판결에 대해 "해당 판결은 최종 판결이 아니며, 작년 제출된 암호화폐 금지법 초안이 인도 의회를 통과할 가능성이 남아있는 등 여러 위험신호가 잔재해 있다"고 주장했다. 그는 이어 "180 페이지 가량의 판결문을 분석한 결과, 법원은 해당 판결에 대해 '중앙은행이 암호화폐 업계의 기본권을 침해한 위헌 소지가 있다'는 점 외에도 '아직 암호화폐 관련 법률이 제정되지 않았다'는 이유를 들고 있다"며 "관련 암호화폐 법이 통과될 경우, 해당 판결은 성립되지 않는다"고 덧붙였다.

[외신 "인도 정부, 암호화폐 거래 금지법 검토 중"]


코인텔레그래프가 인도 미디어 머니컨트롤의 4일 보도를 인용, 인도 정부가 암호화폐 거래를 금지하는 법안을 검토 중이라고 전했다. 익명을 요구한 관계자는 암호화폐 거래 금지법 프레임워크와 관련해 전자정보통신부, 법무부, 인도준비은행(RBI) 간 협의가 시작됐다고 말했다. 인도 의회는 8월 말이나 9월 초에 개회될 것으로 전망된다. 관계자는 "정부는 암호화폐 기업의 은행 거래를 막았던 RBI의 포괄적 금지 같은 방법보다는 법 개정을 통해 암호화폐를 금지하는 것을 검토하고 있다. 암호화폐 거래의 불법성을 명확히 규정하려고 할 것"이라고 설명했다.
